Democrats have continued to threaten to pack the Supreme court with radicals for quite some time now. President Joe Biden has even suggested that he would support packing the SCOTUS and adding as many liberal justices as they can. While this is a clear power grab, one Federal judge is calling the Democrats out.
Justice Stephen Breyer is throwing water on the left’s plan to pack the Courts, adding that if they do this today then Republicans can do it tomorrow.
“What goes around comes around. And if the Democrats can do it, the Republicans can do it,” Breyer said on NPR with host Nina Totenberg.
Breyer accused Democrats of falling into patterns of changing the rules, only for Republicans to “take advantage” of them later. While many Democrats have been hoping for the aging justice to retire, he revealed that he is not interested in retiring anytime soon. He is the court’s oldest member and the senior member of the three-member liberal wing. He admits that he does not want his replacement to “reverse” everything he has done.

Breyer talks about some of this in this new book, “The Authority of the Court and the Peril of Politics,” in which he said changing these things is when people “lose trust in the Court.”
One of the most notable examples of this was when Democrats eliminated the filibuster to approve their court nominees under the Obama Administration. Republicans even warned them that they’d put on their own judges once they get back the majority, which they did under the Trump Administration. Trump then set a new record of court appointments in his very first term. If Republicans can retake the majority in 2022, then they are sure to draw up articles against Joe Biden for a number of reasons.
The Supreme Court is currently comprised of six justices nominated by Republican presidents and three by Democrats. Joe Biden has drafted a commission to make changes to the court and pack it with four more members. He specifically called for more members of the Supreme Court after their 5-4 decision to let a Texas abortion law stand.
But even the late Supreme Court Justice Ruth Bader Ginsberg has talked about her opposition to political court-packing. She skewered the idea during an NPR interview, saying that it would be an explicit attempt to turn the court around to whatever political party was in the White House. She said she was “not at all” for that kind of solution.
Democrats have done all they can to bend and change the rules ever since the Obama administration, and now the Supreme Court is in serious trouble under Joe Biden.
